Ozekhome writes Buhari, demands Nnamdi Kanu’s release

A human rights advocate, Chief Mike Ozekhome (SAN), who is the lead counsel for the detained leader of the proscribed Indigenous Peoples of Biafra (IPOB), Nnamdi Kanu, has written to President Muhammadu Buhari appealing for a ‘political solution’ to terminate the criminal prosecution of his client through nolle prosequi.

In a 44-page letter dated 3rd October which was addressed to the President and delivered, the senior advocate meticulously presented the reasons on why the detained citizen should be released from ‘unlawful’ detention immediately and unconditionally arguing that his client is a victim of political persecution as declared by the UN Working Group, and that the matter has continued to escalate leading to destructions of lives and property in the South East geopolitical zone.

The lawyer recalled the report of the UN Working Group which had ordered federal government to release Nnamdi Kanu which condemned the unconventional way Kanu was arrested alleging that international laws were breached in the arrest and that Nigeria neither addressed substance nor proved a treasonable felony against the victim, and above all, Kanu’s right to freedom of opinion and expression were infringed upon.

According to Chief Ozekhome, the UN Working group also ruled that no effective legal representation was given to Kanu as well as adequate facilities for Kanu’s defence, and categorically condemned ill-treatment of Kanu’s lawyers,

“Your Excellency, the whole world has spoken through the UN Human Rights committee. The message is quite clear: Nnamdi Kanu must be released forthwith – unconditionally. To insist on detaining him in defiance of the world would be at a great price which is better avoided. Suffice it to say, Your Excellency, that just like in the earlier case of Umaru Dikko, your government risked turning Nigeria, once again into a Pariah State simply on account of this avoidable conundrum.

“Your Excellency, if the case of Mr. Dikko was understandable – because it was carried out by a military regime – that of Nnamdi Kanu is inexplicable and unjustifiable under a democratic government headed by your goodself and which operates under a written constitution which guarantees fundamental rights, the rule of law and the enforcement of duly-ratified international treaties.

“Your Excellency, if the case of Mr. Dikko was understandable – because it was carried out by a military regime – that of Nnamdi Kanu is inexplicable and unjustifiable under a democratic government headed by your goodself and which operates under a written constitution which guarantees fundamental rights, the rule of law and the enforcement of duly-ratified international treaties.

“The following narrative clearly shows that this is the case with the relevant treaties under which the United Nations Working Group on Arbitrary Detention issued its binding directive for the immediate and unconditional release of Nnamdi Kanu.

“Your Excellency, I am not aware of any State which has defied or disobeyed such a directive without paying a heavy national price. Nigeria should not be the first member to that “Hall of Infamy” reserved only for Pariah nations. That would be another blot on Nigeria’s image.
